Heatherwilde is a subdivision in Pflugerville, a suburb of Austin, Texas. The subdivision is organized as a Homeowners Association, and is incorporated with the State of Texas under the Name "The Estates of Heatherwilde". This Web site is meant to provide information about the neighborhood to the members of the Homeowners Association.

The Heatherwilde Homeowners Association's Board of Directors meets the second Tuesday of each month at 7:00 pm in the Heatherwilde Clubhouse. The meetings are open to all HOA members. The clubhouse is at 16800 Cactus Blossom Drive. The current acting board of directors consists of the following members (as of Sep 2009):Scot Watson (President; Term expires April 2012) Thad Yousling (Treasurer; Term expires April 2012) Robin Pecht (Secretary; term expires April 2013) Each member is elected to a three year term at the April annual homeowners meeting by a vote of all members present (each property has one vote). Officers are then elected at the following board meeting in April, by a vote of the newly elected board. When a board member leaves the board of directors, the vacated place is filled by appointment of the rest of the board. The newly appointed board member will then serve the remaining term of the member who vacated this position. Any homeowner in Heatherwilde may run for a board position. Would YOU be willing to participate in this way? Please call Goodwin Management, and let them know, or write us a quick note expressing your interest. Better yet, attend an HOA board meeting. The meetings are every second Tuesday of the month at 7:00PM at the Heatherwilde clubhouse (16800 Cactus Blossom Drive). Hope to see you there!

Declarations

Declarations & Bylaws

The Heatherwilde Home Owners Association is a restricted neighborhood consisting of two sections, Heatherwilde Section One and Heatherwilde Section Three. Heatherwilde One is bordered by Black Locust, Heatherwilde Blvd, and the Gilleland Creek (south of Cactus Blossom Dr), while Heatherwilde Three is bordered by Black Locust, Gazania, Heatherwilde Blvd, and Pfennig.

Due to the differing development times for Section One and Three, each section has their own set of declaration that govern it. However, other than the differences in the preamble, the content of the actual rules in these declarations is basically the same. Below is a link to the declarations from Section One.

The execution of these declarations is laid out in the Bylaws of the HOA. The link below shows our current Bylaws.

In addition to that the Board of Directors has recently adopted the "Heatherwilde Fine Procedures" that lay out the procedures to deal with non-compliance to the rules in the Declarations.

Facilities

HOA Facilities

The Heatherwilde Homeowners Association owns several facilities for the general use of it's members in good standing:

- A Clubhouse (located at 16800 Cactus Blossom Drive)

- A pool area with a large 5 foot deep pool and a baby pool

- A park with a playscape and several picnic tables and benches

- A tennis court

- A basketball court

Access to the pool area, tennis and basketball court is restricted to HOA members in good standing with a valid access card (pool) or key (tennis and basketball court). Please contact Goodwin Management to receive a key or access card, if you haven't received one, yet. Click on any of the links below to read the usage rules for the various facilities. The pool is only open during the summer months, click on the link below for this year's pool schedule.

Clubhouse Rental Agreement & Checklist

Rules for the use of the Pools are not specifically addressed in the declaration; however, the association has the authority to maintain these and other common facilities. Rules are necessary for proper maintenance. The Pools as mentioned includes the enclosed, fenced area around the two pools. The Pools are for residents, their children and up to four guests per resident address ONLY. Loaning out the access cards is strictly prohibited and can lead to the loss of pool privileges. A fee of $30.00 will be charged for each access card replacement. Residents not current on their homeowners dues will be denied access. Pool access cards will only be given to residents current on their homeowners dues. POOL RULES These rules apply to: residents, their children and guests. Residents are responsible for their childrens and their guests compliance with these rules. - NO LIFEGUARD ON DUTY. ALL PERSONS USING THE POOL DO SO AT THEIR OWN RISK. - All household members need to identify themselves and their guests to the pool monitor and register their guests. Guests may be asked for proof of age. It is in the monitors discretion to withdraw access privileges from patrons disobeying the rules and require them to leave the pool area. At the Board of Directors discretion, access privileges can be restored at the next scheduled board meeting. - Children under 15 yrs. are absolutely prohibited from pools area without parent or adult (18 yrs. or older) supervision. Children ages 15 to 17 are not allowed to supervise children under the age of 15. - The pool door must not be propped open or otherwise rendered inoperable, even temporarily. - No glass containers, alcoholic beverages, tobacco products, or pets are permitted in the pool area. - Diving into the pools is not permitted. - To protect pool equipment the following are not permitted: - Balloons, cut-off shorts, cutoff shirts, non-toilet-trained children without plastic pants over diapers. - Pool furniture is not to be used in or put into the water. To make the pools safer & cleaner for everyone, please shower to rinse off suntan oils and/or perspiration prior to using the pools. - No swimming permitted during lightning storms. Leave pool and seek immediate cover in the event of a lightning storm. - Safety equipment is to be used only in case of an emergency. - No littering. Use trash receptacles provided. - Resident shall be responsible for paying clean-up expenses, repair costs and damages caused by resident and/or residents guests and children. - Anyone causing a disturbance will be required to leave pools area. Disturbances include, but are not limited to: Running, boisterous play, foul language, inappropriate music and music volume. - Instructions of the pool monitor are to be followed or residents and/or their guests risk being asked to leave the pool and/or loose pool privileges. - The baby pool is intended for babies and toddlers. Constant adult supervision is required. No running or splashing in the baby pool area. POOL PARTIES(Parties may not be exclusive so as to prevent other residents from using the facilities.) Pool party requirements are as follows: - Reservations must be made through the pool monitor (phone number: 251-8907 or 331-7066). - A $50.00 deposit and an agreement to pay for damages over $50.00. - Maximum 25 guests per party (not including members of your household). Guests must obey ALL POOL RULES. - Breakable containers for beverages and food are prohibited. - Parties must end by 9:00 p.m.. Use of the pools area is permitted only according to the approved schedule or by written permission of the management company. At the discretion of the board or the pool management company, the pool area may be closed for maintenance or other reasons from time to time. It is the responsibility of pool users to report rule infractions to the management company. Tennis Court Rules

These rules apply to: residents, their children and guests. Residents are responsible for their children’s and their guests’ compliance with these rules. - Tennis court door must not be propped open or otherwise rendered inoperable, even temporarily. - Individuals caught scaling the fence or otherwise gaining unauthorized access to the tennis court will be reported to the Pflugerville police as trespassing. - Tennis shoes must be worn. - It is recommended that children under 12 are supervised by a parent or adult (18 or older). - No glass containers, alcoholic beverages, tobacco products, or pets are permitted in the tennis court area. - There is no time limit on using the tennis court. However, if others are waiting, please limit play to 1 hour. - No littering. Use trash receptacles provided. - Resident shall be responsible for paying clean-up expenses, repairs costs and damages caused by resident and/or resident’s guests. - Tennis court is for tennis only. All other uses are prohibited including, but not limited to: skateboarding, rollerblading, and biking. = Anyone causing a disturbance will be required to leave the tennis court area. Disturbances include, but are not limited to fighting, foul language, inappropriate music and music volume. This court is for the enjoyment of Heatherwilde residents and their guests only. It is up to homeowners to report rule infractions to the management company:Goodwin Management at 502-7509.

Heatherwilde Clubhouse Rental Agreement The Heatherwilde Clubhouse is available for rental by the homeowners of Heatherwilde H.O.A.. Reservations can be made by contacting Marilyn Childress/Goodwin Management at 512-502-7509. Reservation dates will be on a first-come, first-served basis. Clubhouse Rental shall include a check for the fee of $85 per day and a check for the deposit of $175, both due at the time of reservation. A $25 return fee will be assessed to the homeowner for all returned checks. Cancellation of the reservation is only permissible if the Heatherwilde H.O.A. is notified no less than 10 days prior to the event date, at which time the homeowner will be refunded both the day fee and deposit in full. Cancellation of the reservation within 10 days of the reserved event date will result in the forfeiture of the $85 fee per day reserved.Please note that homeowners with outstanding Heatherwilde H.O.A. dues are ineligible to reserve and/or rent the clubhouse until all dues have been paid in full.The H.O.A. reserves the right to cancel a reservation in the event the Clubhouse suffers damage or system failure that cannot be corrected prior to the reservation date scheduled. Such a cancellation by the H.O.A. will result in a full refund of both use fee and deposit to the homeowner.Rules of UsageHomeowner ("Renting Party") agrees to: - 100% responsibility for the conduct of all guests attending the event. - Remain at the Clubhouse for the duration of the rental period until all guests have departed the event. - Maximum number of 80 guests allowed at the event. - Inform guests of designated parking spots including street parking in front of the Clubhouse. - Be considerate of neighboring homeowners at all times. - Use of the facility must end at 12 a.m. unless the Board or the Manager approves a longer period of use, in which case additional conditions may be imposed. - Limit noise/music levels. - No smoking inside Clubhouse or near Clubhouse doorways. - No firearms allowed on the premises. - Abide by the laws of the State of Texas as they relate to the serving and consumption of all alcoholic beverages. - Lock door and place key in the lockbox immediately following the event. A lost clubhouse key will result in a ‘lost key fee’ of $30 to be assessed to the homeowner. - Notify property manager of any problems encountered and any damage to Clubhouse and/or grounds during use. - In the event that the property is damaged to the extent that it cannot be rented to another homeowner, there will be a fine of $10 per day assessed to the renter until all damages to the Clubhouse and/or grounds are repaired to its original condition. In addition, the Renting Party will at the Board's discretion be ineligible for any additional use of the HOA Clubhouse. - Clean the Clubhouse and surrounding grounds immediately following the event. The Renting Party is responsible for proper cleanup of the facilities and for any damages. The Renting Party will be charged the costs of any necessary cleanup and for any and all repairs. No deposit will be returned until the premises are cleaned as suggested by the checklist provided to the Renting Party and the premises are inspected by the HOA Board's designated representative. - Falsification of the stated purpose of rental within this contract constitutes fraud resulting in a fine no less than $175 assessed to the Renting Party. - Any repair costs, fines or charges in excess of the $175 deposit shall be posted to the homeowner’s H.O.A. account. - Agrees by signing this agreement that he/she has been legally notified of the fees, fines and charges under the specified conditions stated within this agreement. He/she may request in writing a hearing before the H.O.A. Board within 30days of the posting of any fee, fine or charge to the homeowner's account as a result of this rental. HEATHERWILDE CLUBHOUSE CHECK LISTThe Heatherwilde Clubhouse is here for your enjoyment. This checklist will help assure the next person finds the facility as enjoyable. Please take a minute to follow the recommendations provided. Observing the checklist will help insure a full refund of your deposit.GENERAL REQUESTS - Place tape or decorations on glass only and remove when finished. Do not place tape on light fixtures or walls. - Do not place staples in chairs, walls or tables and please remove all tape used on these items. - YOU MUST DEPART THE BUILDING NO LATER THAN 12:00 MIDNIGHT TO AVOID A FINE. AN ADDITIONAL FINE WILL BE INCURRED BY THE HOMEOWNER unless the Board approves a longer period of use, in which case additional conditions may be imposed CLOSING OF CLUBHOUSE - Clean up appliances and countertops that were used in kitchen - Bag and tie trash bags. Place in the blue dumpsters located outside the clubhouse or pool area across the street. - Turn off the sound system and television if you used them. - Take down ALL decorations placed inside and outside the center, and clean up ALL messes. Please sweep the floors. Mop floors if necessary to remove standing pools and spills. - Wipe off ALL tables/chairs and put them away in the storage closet. - Turn off ALL lights, fans, water faucets, stove burners and oven. - Remove ALL foods/beverages from the refrigerator and freezer. - Close, secure and recheck ALL windows. Please be sure to secure all latches/locks. - Close, secure and recheck ALL doors. Please be sure to secure all latches/locks on the front door and back doors. - Return the clubhouse key. - Put trash can to the street.
